Bloomberg Law: Judges Again Ponder Reduced Attorney Fees in Chicken Cartel Case

An attorney hoping to reduce the fees granted to counsel in a major poultry price-fixing case warned federal appellate judges against condoning “a one-way ratchet, permanently going up” as they consider whether a district judge’s award constitutes an abuse of discretion.

“It really comes down to whether the court wants to enforce its market-mimicking approach,” attorney Ted Frank told a US Court of Appeals for the Seventh Circuit panel. He urged them during oral arguments Wednesday to prioritize “ex ante” evidence dating from around the time the litigation was filed because subsequent awards “have consistently been above the marketplace.”
